Terms of Service

Welcome to CareComm App! These Terms of Service ("Terms") govern your access to and use of the CareComm App, including any content, functionality, and services offered on or through the CareComm App (the "App").
By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use the App.
1. Acceptance of Terms
By creating an account, accessing, or using the CareComm App, you affirm that you are of legal age to enter into this agreement and that you accept and agree to be bound by these Terms. If you are using the App on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. You represent and warrant that all information you provide is accurate and complete.
2. Changes to the Terms
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes. We will notify users of material changes via email or through the App.
3. Accessing the App
We reserve the right to withdraw or amend this App, and any service or material we provide on the App, in our sole discretion without notice. We will not be liable if for any reason all or any part of the App is unavailable at any time or for any period. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
4. Intellectual Property Rights
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by CareComm Software Co., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, or transmit any content without our prior written permission.
5. Trademarks
The CareComm name, the CareComm logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CareComm Software Co. or its affiliates or licensors. You must not use such marks without the prior written permission of CareComm Software Co. Other trademarks, service marks, logos, and trade names that may appear on the App are the property of their respective owners.
6. Prohibited Uses
You may use the App only for lawful purposes and in accordance with these Terms of Service. You agree not to use the App:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
- To impersonate or attempt to impersonate any person or entity
- To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
- To upload, post, email, or otherwise transmit any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- To attempt to gain unauthorized access to any portion or feature of the App
- To interfere with or disrupt the integrity or performance of the App or third-party systems
7. User Contributions
The App may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit to other users or other persons content or materials (collectively, "User Contributions"). All User Contributions must be your own original work or you must have obtained all necessary permissions from the copyright holder.
8. Content Standards
All User Contributions must comply with the Content Standards set out in these Terms of Service. User Contributions must not:
- Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
- Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- Infringe any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any party
- Violate the privacy or publicity rights of any third party
- Constitute or encourage conduct that would constitute a criminal offense or give rise to civil liability
9. Monitoring and Enforcement
We reserve the right, in our sole discretion, to remove or refuse to post any User Contributions, suspend or terminate user accounts, restrict access to the App, or take any other action we deem necessary if we believe a user has violated these Terms, applicable laws, or poses a risk to the App, its users, or CareComm Software Co.
Where reasonably practicable, we may notify the affected user of the enforcement action and the reason for it. If you believe your account or content has been suspended, removed, or restricted in error, you may submit an appeal through the customer support system available within the CareComm App.
10. Reliance on Information
The information presented on or through the App is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.
11. Links from the App
If the App contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
12. Disclaimer of Warranties
YOUR USE OF THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP IS AT YOUR OWN RISK. THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
13. Limitation on Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL CARECOMM SOFTWARE CO., ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP.
14. Indemnification
You agree to defend, indemnify, and hold harmless CareComm Software Co., its affiliates, licensors, and service providers from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms of Service, your use of the App, or your violation of any rights of another person or entity.
15. Governing Law and Jurisdiction
All matters relating to the App and these Terms of Service shall be governed by and construed in accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes.
16. Entire Agreement
The Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and CareComm Software Co. regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the App.
17. Third-Party Platform Integrations
The CareComm App may integrate with third-party platforms and services, including but not limited to Meta (Facebook and Instagram), TikTok, YouTube, Google, and other external providers. These integrations depend on third-party APIs, services, and policies that are outside the control of CareComm Software Co. We are not responsible for any interruption, limitation, modification, deprecation, suspension, or discontinuation of any third-party API, platform feature, or service that may affect the functionality of the CareComm App.
18. Data Retention and Account Deletion
If you permanently delete your account, all Customer Data associated with that account will be permanently deleted from our active systems without undue delay, except where retention is required by applicable law. If your account is suspended, disabled, or otherwise inactive, your Customer Data will remain securely stored in our systems and may be archived until you request permanent deletion or your account is reactivated. You may request permanent deletion of your archived Customer Data at any time through the CareComm App or by contacting Customer Support.
19. Data Ownership
You retain all ownership rights to the data, content, customer information, communications, and other materials that you upload, submit, create, or manage through the CareComm App ("Customer Data"). CareComm Software Co. does not claim ownership of your Customer Data. We process and store such data solely for the purpose of providing, maintaining, securing, and improving the Services in accordance with these Terms and our Privacy Policy.

YouTube (Google):
By using the CareComm App, you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). The CareComm App complies with YouTube API Services Terms of Service. You can revoke CareComm App's access to your YouTube data via the Google security settings page.
Meta (Facebook/Instagram):
Your use of the CareComm App, particularly in connection with Meta platforms, is subject to the Meta Platform Terms (https://developers.facebook.com/terms/dfc_platform_terms/) and Meta Developer Policies (https://developers.facebook.com/devpolicy/).
TikTok:
Your use of the CareComm App in connection with TikTok services is subject to TikTok's Terms of Service and Developer Terms.
